Inheritance according to Israeli law

Inheritance according to law is one that will be distributed according to the Israeli law of inheritance from 1965, in cases where no will was made by the deceased. 

The Israeli Inheritance laws deal with the transfer of a deceased person’s estate to his heirs. The inheritance law states that upon the death of a person His estate passes to his heirs, and the deceased’s estate cannot be distributed until after the receiving of an inheritance order that declares the identity of the heirs and their share in the estate in the absence of a will.

Drawing up a will allows every person to exercise his right to dictate how his rights will be inherited. This right is also anchored in a fundamental law: human dignity and freedom. In this matter the Israeli Supreme Court rules: “We recognize the right of a person – and a person is each one of us – to control the distribution of his assets after death, and that According to him there will be a thing… the will of the person is from the honor of the person (the will of the person is his honor). We will preserve the honor of the dead and he is the honor of the living.”

The probate petition must be accompanied by a large number of documents including the following:

  1. Drafting a probate petition from A to Z including translation.
  2. Foreign law opinion regarding the Domicile of the deceased.
  3. A Succession Order petition alongside an affidavit signed by the petitioner, who must be one of the heirs, the estate manager, or a creditor of an heir. The petitioner’s declaration must be verified by an attorney, notary, judge, or head of the local council or your local Israeli consulate.
  4. An original death certificate. If the deceased passed away outside of Israel an Apostille is required.
  5. Formal notices to all remaining heirs notifying them of the Succession Order Petition, including the aforementioned heirs’ signatures or confirmation of delivery of the notices by registered mail.
